Subject: Consideration of Requests for Determination of Funding as Required for Nonclassroom-Based Charter Schools Pursuant to California Education Code Sections 47612.5 and 47634.2, and Associated California Code of Regulations, Title 5.

Recommendation: The CDE recommends that the California State Board of Education (SBE) approve the funding determination requests for the charter schools at their requested levels of funding and for the time periods specified in Item 01 Attachment 01: Proposed Recommendations for Nonclassroom-Based Determination of Funding (XLSX).

Action: Commissioner Brasil moved for recommendation to the SBE of the CDE staff recommendation.

Commissioner King seconded the motion.

No votes: Commissioner Jones

Recusals: Commissioner Walsh

The motion passed by a vote of six to one.

Item 02

Subject: Consideration of Requests for Determination of Funding with “Reasonable Basis”/Mitigating Circumstances as Required for Nonclassroom-Based Charter Schools Pursuant to California Education Code Sections 47612.5 and 47634.2, and Associated California Code of Regulations, Title 5.

Recommendation: The CDE recommends that the SBE approve the funding determination with mitigating circumstances requests for the charter schools as specified in Item 02 Attachment 01: Proposed Recommendations for Nonclassroom-Based Determination of Funding with Mitigating Circumstances (XLSX).

Action: Commissioner Olmos moved for recommendation to the SBE of the CDE staff recommendation.

Commissioner Park seconded the motion.

Yes votes: Commissioners Brasil, Finnell, King, Olmos, and Park
No votes: Commissioner Jones
Absences: None
Abstentions: None
Recusals: Commissioners Taylor and Walsh

The motion passed by a vote of five to one.
