Subject: Consideration of Requests for Determination of Funding as Required for Nonclassroom-Based Charter Schools Pursuant to California Education Code sections 47612.5 and 47634.2, and Associated California Code of Regulations, Title 5.
CDE Recommendation: The CDE proposes to recommend that the California State Board of Education (SBE) approve the schools’ determination of funding requests at 100 percent for the time periods specified in Item 1 Attachment 1: Proposed Recommendations for Nonclassroom-Based Determinations of Funding (XLSX).

- Motion 1: Commissioner King moved for a recommendation to approve the schools' determination of funding requests at 100 percent for a period of five years.
Commissioner Brasil seconded the motion.

Subject: Consideration of Requests for Determination of Funding with “Reasonable Basis”/Mitigating Circumstances as Required for Nonclassroom-Based Charter Schools Pursuant to California Education Code sections 47612.5 and 47634.2, and Associated California Code of Regulations, Title 5.
CDE Recommendation: The CDE proposes to recommend that the SBE approve the schools’ determination of funding requests at 100 percent for the time periods specified in Item 2 Attachment: Proposed Recommendations for Nonclassroom-Based Determinations of Funding with Mitigating Circumstances (XLSX; REVISED 09-Jun-2023).
Actions: Commissioner Brasil moved for recommendation to the SBE of the CDE staff recommendation.

Subject: Appeal of the Denial of a Petition for the Establishment of a Classroom-Based Charter School Pursuant to California Education Code Section 47605(k)(2): Consideration of Evidence to Hear or Summarily Deny the Appeal of New Pacific School – Yuba City, which was denied by the Yuba City Unified School District and the Sutter County Board of Education.
CDE Recommendation: The CDE recommends that the Advisory Commission on Charter Schools issue a recommendation to the SBE to hear the New Pacific School – Yuba City appeal. This recommendation is based upon the CDE’s review of the documentary record, which set out sufficient evidence to hear the appeal.
Actions: Commissioner Finnell moved for recommendation to the SBE of the CDE staff recommendation.
