Subject: Consideration of a Retroactive Request for Determination of Funding with “Reasonable Basis”/Mitigating Circumstances as Required for Nonclassroom-Based Charter Schools Pursuant to California Education Code sections 47612.5 and 47634.2, and Associated California Code of Regulations, Title 5.
CDE Recommendation: The CDE proposes to recommend that the State Board of Education (SBE) approve the mitigating circumstances request and approve the determination of funding request at the percentage and for the time period specified for W.E.B. DuBois Public Charter as provided in Attachment 1 and as shown below:
- 100 percent for two years (2020‒21 through 2021‒22)
Action:
First motion: Commissioner Garbolino-Mojica moved for reccomendation to the SBE to approve the school at 85 percent funding for two years.
Commissioner Walsh seconded the motion. Following lengthy discussion, Commissoner Garbolino-Mojica withdrew her motion.
Second motion: Commissioner Austin moved for recommendation to the SBE of the CDE staff recommendation.
Commissioner Walsh seconded the motion.
Yes votes: Commissioners Austin, Berumen, Farland, Garbolino-Mojica, Sever, and Walsh
No votes: Commissioner Jones
Members absent: Commissioner Walmsley
Abstentions: None
The motion passed by a vote of six to one.

Subject: Consideration of Requests for Determination of Funding as Required for Nonclassroom-Based Charter Schools Pursuant to California Education Code sections 47612.5 and 47634.2, and Associated California Code of Regulations, Title 5.
CDE Recommendation: The CDE proposes to recommend that the SBE approve the determination of funding requests at the percentages and for the time periods specified for the charter schools as provided in Attachment 1 and as shown below:
- 100 percent for two years (2020‒21 through 2021‒22):
- California Virtual Academy at Kings
- Cabrillo Point Academy
- California Virtual Academy @ Sonoma
- California Virtual Academy at Sutter
- 85 percent for two years (2020‒21 through 2021‒22):
- Insight @ San Diego
- Insight @ San Joaquin
Action:
First motion: Commissioner Austin moved for recommendation to the SBE to approve all schools at 100 percent funding.
No commissioner seconded the motion.
Second motion: Commissioner Garbolino-Mojica moved for recommendation to the SBE of the CDE staff recommendation to approve the determination of funding requests for California Virtual Academy (CAVA) schools (California Virtual Academy at Kings, California Virtual Academy @ Sonoma, and California Virtual Academy at Sutter) at 100 percent for two years.
Commissioner Walsh seconded the motion.
Yes votes: Commissioners Austin, Berumen, Farland, Garbolino-Mojica, Sever, and Walsh
No votes: Commissioner Jones

The motion passed by a vote of six to one.
Third motion: Commissioner Garbolino-Mojica moved for recommendation to the SBE of the CDE staff recommendation to approve the determination of funding requests for CAVA/Insight schools (Insight @ San Diego and Insight @ San Joaquin) at 85 percent for two years with the acknowledgement that the CDE staff's recommendation may change should the schools provide additional clarifying information to support recommendations for 100 percent funding.
Commissioner Walsh seconded the motion.

No votes: Commissioners Austin and Jones

The motion passed by a vote of five to two.
Fourth motion: Commissioner Walsh moved for recommendation to the SBE of the CDE staff recommendation to approve the determination of funding request for Cabrillo Point Academy at 100 percent for two years.
Commissioner Austin seconded the motion.
Yes votes: Commissioners Austin, Farland, Sever, and Walsh
No votes: Commissioner Jones
Members absent: Commissioner Walmsley
Abstentions: Commissioners Berumen and Garbolino-Mojica
The motion did not pass by a vote of four to one with two abstentions. Five votes are required to move an ACCS recommendation to the SBE: therefore, no formal recommendation was moved.
Adjournment of Meeting
Commissioner Sever adjourned the meeting at approximately 11:56 a.m.
