Guidance: Title III English Learner Program

Subgrant Period

The funding period for fiscal year (FY) 2021–22 Title III subgrants runs from July 1, 2021, to September 30, 2023.

Obligations

The Elementary and Secondary Education Act (ESEA), Section 3115(c)(1)(2) and (d) defines allowable expenditures for Title III English Learner (EL) program subgrant funds.

All obligations must be liquidated no later than 90 calendar days after the funding period end date. For the FY 2021–22 subgrants, all obligations must be liquidated by December 30, 2023. Any local educational agency (LEA) reporting unexpended funds after this date will be invoiced by the California Department of Education (CDE). According to the California School Accounting Manual, “Legal obligations are commitments made by an LEA to purchase goods or services immediately or in a future period.” To determine whether a financial commitment should be reported as an obligation, please refer to the Code of Federal Regulations (CFR) Title 2, Section 200.34 of the Electronic CFR External link opens in new window or tab. web page.

Direct Administrative Costs

LEAs may use no more than 2 percent of the EL program subgrant for direct administrative costs for fiscal year (ESEA Title III, Section 3115 [b]).

Indirect Costs

An LEA can apply its approved indirect rate to the portion of the subgrant that is not reserved for direct administrative costs. A list of approved indirect cost rates are available on the CDE Indirect Cost Rates web page.

Supplement, Not Supplant

Federal funds made available under Title III subgrants shall be used to supplement the level of federal, state, and local public funds that, in the absence of such availability would have been expended for programs for English learners and immigrant children and youth and in no case to supplant such federal, state, and local public funds. (ESEA Title III, Section 3115 [g])
