Important Notice: Programs Moved to CDSS

While the California Department of Education continues to operate the California State Preschool Program, the Early Childhood Development Act of 2020 (Senate Bill (SB) 98, Chapter 24, Statutes of 2020) authorized the transfer of many childcare programs from the California Department of Education to the California Department of Social Services (CDSS) effective July 1, 2021. Authority: Senate Bill (SB) 792, Statutes of 2015 Chapter 807, Amendments to the California Health and Safety Code (HSC) sections 1597.055 and 1597.54, and adds sections 1596.7995 and 1597.622 to the HSC.

Purpose

This Management Bulletin informs contractors with the California Department of Education, Early Learning and Care Division, of changes in the Health and Safety Code (HSC) regarding staff and volunteer immunization requirements.

Authority

SB 792 amends sections 1597.055 and 1597.54 of the HSC and adds sections 1596.7995 and 1597.622 to the HSC.

Directive

Effective September 1, 2016, a person may not be employed or volunteer at a child care center or family child care center unless he or she has been immunized against influenza, pertussis, and measles or qualifies for an exemption. Unless an exemption applies, each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year.

The provisions of SB 792 are administered by the California Department of Social Services, Community Care Licensing Division (CDSS-CCLD).
