Attention: All California Work Opportunity and Responsibility to Kids (CalWORKs) Stage 2 Contractors
Purpose
This Management Bulletin (MB) is to remind CalWORKs Stage 2 contractors that Stage 2 is an entitlement program and they must continue to transfer families into the program and provide services.
Authority
California Education Code (EC) sections 8350.5 and 8353 provide current CalWORKs and former recipients (for up to 24 months after leaving cash assistance) are entitled to receive CalWORKs Stage 2 child care services as long as they continue to meet eligibility and need requirements.
Policy
In accordance with EC Section 8350.5 and California Code of Regulations, Title 5 (5 CCR), Section 18408(a), recipients receiving CalWORKs cash aid are categorically eligible to receive CalWORKs Stage 2 child care services as long as they are in an approved CalWORKs activity or employed.
Former CalWORKs cash aid recipients are entitled for up to 24 months of Stage 2 child care in accordance with EC Section 8353 and 5 CCR, Section 18408 (d), as long as they meet eligibility and need requirements specified in 5 CCR sections 18406 and 18407.
CalWORKs Stage 2 contractors must continue to enroll families into Stage 2 in accordance with 5 CCR sections 18409 and 18409.5 unless directed otherwise by the Early Learning and Care Division (ELCD).
Contractors should immediately contact their Child Development Fiscal Analyst at http://www.cde.ca.gov/fg/aa/cd/faad.asp anytime their contract Maximum Reimbursement Amount is not sufficient to cover the families being transferred into Stage 2.
