Emergency Assistance to Non-Public Schools Program

A program sponsored under the federal Coronavirus Response and Relief Supplemental Appropriations Act (CRRSA) to provide funding to non-public Private Schools and eligible Non-Public Schools (NPS), 2021.

American Rescue Plan (ARP) Emergency Assistance to Non-public Schools (EANS) Program Requirements

As part of the ARP 2021, Public Law 117-2, Public Law 117-2, Congress set aside $2.75 billion of the Governor’s Emergency Education Relief Fund specifically to provide emergency assistance to students and teachers in non-public schools (NPS), as defined below, through the ARP EANS program. The purpose of the ARP EANS program is to provide services or assistance to NPS that enroll a significant percentage of students from low-income families and are most impacted by the Coronavirus Disease 2019 emergency.

On September 9, 2021, Governor Newsom applied for California’s EANS award. California received an ARP EANS award on November 4, 2021, of $181,312,003, of which $180,405,443 was allocated to eligible NPS. The California Department of Education (CDE) is responsible for the administration of the ARP EANS program.

ARP EANS Late Liquidation Update and Information

The CDE submitted a request for Late Liquidation to the U.S. Department of Education (ED) on April 4, 2024. On June 3, 2024, the CDE was notified that the request was approved by ED. With this decision, the performance period has been extended until June 30, 2025. Schools may continue to receive services until the end of the next academic year if they have the funding available. No new funding will be provided.

Although services have been extended, the obligation period has not. All funding under this program must be obligated before September 30, 2024. With that, purchase orders will not be approved by the CDE past the deadlines noted below:

Eligible schools will need to continue to work with California approved vendors to submit purchase orders for services.

The CDE will not accept any purchase orders for consideration after the final cutoff date of August 30, 2024.

ARP EANS Office Hours

The CDE will be offering ARP EANS Office Hours via Zoom in August as noted below. These meetings will allow one administrator at a time to enter the meeting space and ask questions.

Coronavirus Response and Relief Supplemental Appropriations Act (CRRSA) Information

As part of the CRRSA Act, 2021, Public Law 116-260, Congress set aside $2.75 billion of the Governor’s Emergency Education Relief Fund specifically to provide emergency assistance to students and teachers in non-public schools through the EANS program.

Performance period of CRRSA ended on June 30, 2024.

With the ending of this grant, schools must adhere to the following requirements:

The US Department of Education’s disposition guidance offers options that the State Educational Agency (SEA) may consider as the program closes.

An SEA may allow private schools to use EANS-purchased equipment and supplies beyond the relevant grant’s period of performance if:

  • The SEA, in coordination with appropriate private school officials, determines a school continues to need the items for EANS purposes.
  • The SEA in coordination with appropriate private school officials determines a school needs the items for another federal program in which the school participates, such as equitable services.

Under the Disposition Guidance from ED, if a school no longer needs EANS-purchased supplies for allowable purposes, then the school will follow the disposal rules, which depend on how much the supplies are now worth.

  • If, in total, the supplies provided to a school are now worth less than $5,000:
    • The school can either keep the items or dispose of them with no further obligation to ED or the CDE.
  • If, in total, the supplies provided to a school are now worth more than $5,000:
    • The school will sell the items at current value and compensate the CDE for those items, who in turn will compensate ED. Under this, the SEA has the responsibility of compensating ED for its share of the current value.

The CDE has provided an inventory sheet for schools to fill out and return.
